Reporting: After the August 8, 2022 FBI search of Mar-a-Lago, Fox News published “National Archives official who notified DOJ in Trump probe declined to do the same over Clinton emails.” The piece quotes the February 18, 2022 Maloney letter (“NARA staff has been in communication with the Department of Justice”) and the 2015 Grassley reply declining a formal Attorney General recovery action. It says NARA’s own timeline showed NARA learned of Clinton emails in March 2015, before Justice reportedly began its classified-information review, and that NARA did not notify DOJ of its own review.

A second Fox piece, “National Archives silent as disparity between its handling of Biden, Trump documents fuels questions,” notes Ferriero as an Obama-era official who remained through Trump’s presidency and under whose watch NARA “went to battle with Trump over his records.” The Washington Examiner ran a related disparity piece on NARA’s public statements about Trump versus silence on Biden documents; that article quotes Ferriero’s February 2022 PRA lines and then moves to Acting Archivist Wall. Wall’s later answers are not Ferriero’s acts.

Label this band correctly. Fox and the Examiner are reporting and commentary. The two Ferriero letters are primary. The disparity claim is an argument. It is not a conviction.
